Terms of Service

The short version

1. Agreement

These Terms of Service (the "Terms") are a binding agreement between you and Shotdrum Studios, LLC ("Shotdrum", "we", "us") covering the Grist apps, the Grist web app, and the Grist backend service (together, "Grist"). By creating an account or using Grist, you agree to these Terms and to the Privacy Policy. If you don't agree, don't use Grist.

2. Eligibility

You must be at least 13 years old to create an account, and you must be of legal drinking age in the place you live (21 in the United States) to use Grist, because it is a homebrewing app. You are responsible for complying with the laws where you live regarding brewing, possessing, transporting, and sharing alcohol — including homebrew volume limits and competition shipping rules. Grist does not give legal advice, and nothing in the app should be read as permission to do something your local law prohibits.

3. Your account

Give us accurate information when you sign up, and keep your sign-in method secure. Accounts are for one person; don't share yours. You're responsible for what happens under your account. Tell us at hello@gristbrew.app if you think it's been compromised.

You can delete your account at any time from Settings in the app or the web app. See the Privacy Policy for what that removes.

4. Beta software

Parts of Grist are distributed as beta or pre-release software, including through Apple's TestFlight. Beta versions are, by nature, incomplete and may contain defects. They may lose data, behave incorrectly, or be discontinued. Don't use a beta version as the only record of anything you can't afford to lose, and keep your own backups of important recipes and results.

5. Your content

You own your brewing data — your recipes, batches, notes, inventory, competition entries, results, and everything else you put into Grist. We claim no ownership of it.

You grant us a limited, non-exclusive, worldwide, royalty-free license to store, copy, transmit, and process your content solely to operate and improve Grist for you — syncing it between your devices, backing it up, and generating the AI insights you ask for. This license exists only so we can run the service; it ends when you delete the content or your account. We don't publish your content, share it with other users, or use it to train machine-learning models.

You are responsible for your content, and you confirm you have the right to upload it — including any recipe you didn't write yourself.

6. Acceptable use

7. Grist Pro, billing, and cancellation

Grist has a free tier. Grist Pro is a paid subscription that unlocks additional features. During the beta period, features may be free that will later require Pro.

Subscriptions renew automatically at the then-current price until you cancel. Cancel at least 24 hours before the period ends to avoid the next charge. Cancelling stops future renewals; you keep Pro through the end of the period you already paid for. Except where the law requires otherwise, payments are non-refundable and we don't prorate partial periods — refund requests for App Store purchases go to Apple.

We may change pricing. Price changes apply to renewals only, and we'll give you notice before one takes effect so you can cancel.

8. AI features

Grist's Sight features use AI to generate suggestions, summaries, and insights from your data. AI output can be inaccurate, incomplete, or plainly wrong. Treat it as a starting point, not an authority. Do not rely on it for decisions with safety, health, food-safety, legal, or financial consequences — including whether a beer is safe to drink, whether a fermentation is sound, or whether an entry meets a competition's rules. Verify anything that matters. We make no warranty about AI output, and AI features may be rate-limited, changed, or withdrawn.

9. Third-party services

Grist can connect to services we don't control — Brewfather, Brewer's Friend, Google Sheets, and competition and homebrew-organization websites. Those connections are optional and governed by the third party's own terms. We're not responsible for their availability, accuracy, or content, and a change on their end may break a feature without notice. Competition and AHA program data shown in Grist is gathered from public sources and may be out of date or incorrect; always confirm deadlines, rules, and results with the organizer.

10. Our intellectual property

Grist — the apps, the backend, the design, the name, and the logo — is owned by Shotdrum Studios, LLC and protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable license to use Grist as intended by these Terms. All rights not expressly granted are reserved. Trademarks including BJCP, AHA, Apple, and Google belong to their respective owners; Grist is not affiliated with or endorsed by them.

11. Suspension and termination

You may stop using Grist and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if we're required to by law, or if we discontinue the service. If we discontinue Grist, we'll give reasonable notice and an opportunity to export your data. Sections 5, 10, 12, 13, 14, and 16 survive termination.

12. Disclaimers

GRIST IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that Grist will be uninterrupted, error-free, or secure, that defects will be corrected, or that your data will never be lost. You are responsible for keeping your own copies of anything important.

Grist is a record-keeping and planning tool. It is not a source of food-safety, medical, or legal advice.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOTDRUM STUDIOS, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR SPOILED, LOST, OR UNSUCCESSFUL BATCHES, ARISING OUT OF OR RELATED TO YOUR USE OF GRIST.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO GRIST IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS.

Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

14. Indemnification

You agree to indemnify and hold harmless Shotdrum Studios, LLC from claims, damages, and reasonable legal fees arising out of your content, your use of Grist, or your violation of these Terms or of any law.

15. Changes to Grist and to these Terms

We may add, change, or remove features. We may also update these Terms; when we do, we'll revise the "last updated" date and, for material changes, notify you in the app or by email before they take effect. Continuing to use Grist after a change takes effect means you accept the updated Terms. If you don't accept them, delete your account.

16. Apple App Store

If you obtained Grist through the App Store, you acknowledge that these Terms are between you and Shotdrum Studios, LLC only — not Apple. Apple has no obligation to provide maintenance or support for Grist, and is not responsible for any claim relating to it, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or to Grist will be brought exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction. If you live somewhere whose law entitles you to bring a claim locally, this section does not take that right away.

18. General

These Terms and the Privacy Policy are the entire agreement between you and us about Grist. If a provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
